 Road openings are governed by the following legislation :

 

 ROADS ( SCOTLAND ) ACT 1984, SECTION 56 TRANSPORT (SCOTLAND) ACT 2005

Under which:

 1 No excavation work shall be made in, or under, a public road without the Roads Authorities written consent and subject to any conditions attached to the Permit. Persons contravening this Section are guilty of an offence and liable to a fine.

2 Any damage to the public road as a result of the works is to be included in the permanent reinstatement. The applicant is responsible for the reinstatement for twelve months from completion of the work after which the Roads Authority will reinspect the work for compliance. Any remedial work required will be the responsibility of the applicant.

3 Any work found to be in progress but being undertaken in contravention of item 1 will be closed down and backfilled by the Roads Authority. All expenses so incurred by the Roads Authority will be recovered from the contractor responsible for the opening. Similarly where any remedial works required after the twelve month maintenance period are not carried out within four weeks of the applicant being notified in writing of the remedials then the Roads Authority will carry out the work and recover any costs incurred from the applicant.
